Personal Financial Relief: The bankruptcy court provides instant relief from debt, pressure, garnishment, IRS attachment, foreclosures.
Personal Financial Planning: The goal of the bankruptcy court is to help you out of debt, or to help you to reorganize your debt; an excellent opportunity to take control of finances and make a commitment to stay out of debt.
Small Business Financial Adjustment: Many small businesses elect to stay in business after bankruptcy. Without the burden of debt, but the benefit of experience, the personal investment can start to pay off. A small business can elect to get out of debt through chapter 7, reorganize it's debt through chapter 11 or chapter 13, or in the case of a small family farm, through chapter 12.
BANKRUPTCY ABUSE PREVENTION AND CONSUMER PROTECTION ACT OF 2005: This new law will facilitate processing of Chapter 13 payment programs under a much more positive environment. It looks like the new law will be "A GOOD THING".
Sponsored by Credit Card Companies and Consumer Groups, the new Chapter 13 will allow you to pay what you can, receive a discharge on the rest, clean up your credit, while under complete protection of the Bankruptcy Court.
This program will satisfy all creditors, and is encouraged by creditors.
Even the new program for chapter 7 ( the standard "get out of debt" chapter) is revised to the satisfaction of the creditors.
Both programs are equally available, depending upon your circumstances.
BANKRUPTCY IS NO LONGER A STIGMA:This new law was written primarily by credit card companies.
The new law is solidly backed and encouraged by these credit companies.
The new act allows you to pay what you can. Everyone is satisfied in the end. Upon completion you will receive a discharge of all debts, whether paid or not.
UNLIKE SO CALLED "NON PROFIT" CREDIT AGENCIES: You and your family are fully protected by the Court, while you are paying your debts. Independent credit agencies cannot provide this protection. In addition, at the end of your case, your past credit problems are cleared from the report, providing in their place, a perfect payment history to the Chapter 13 trustee.
